I actually threatened to sue a spammer one time, about a year ago, and they settled out of court with me. I live in Nevada, which has some of the strictest anti-spam laws in the nation.
This company out of New Jersey was sending me spam for home refinancing, water purifiers, free cell phones, you name it. I tried to unsubscribe, but of course that rarely works. I kept getting spam from them.
So one day I e-mailed the vice president of the company, sent him some snippets of the Nevada spam laws, and I basically told him to remove me or face a lawsuit. I would be seeking damages for all my lost time in dealing with the countless spams they sent me.
He responded that I was removed. A week later I get another spam from them. I contacted him again and sent a copy of the spam, and told him now the gloves are off. You've continually violated my state laws, lied to me by telling me that I was off your list, and now you're gonna pay.
Well, the story is much longer than that, but to make it short he had their attorney e-mail me to discuss it. He claimed that they could PROVE that I opted into their list (which I knew I didn't). So I said, "No problem then. You won't mind if I subpeona your server logs for the last year to see if we can find an IP address that can be connected to me."
They ended up settling for $250, and I had to sign an agreement that I would never reveal the name of the company. Just wanted to share my story.
